Terms of Service

1. Acceptance of these terms

By creating an account or using CobraYa!, the Client accepts these Terms of Service in full. If you do not agree, you must not use the platform.

2. Description of the service

CobraYa! is a CRM and messaging platform operated by KollaLabs that lets businesses ("the Client") send payment reminders and other communications to their own customers or debtors over WhatsApp, SMS, and email, and track the status of those communications.

3. Client responsibility for use of the platform

The Client is solely responsible for:

• Having a valid relationship or legal basis with each recipient before contacting them through the platform.
• Complying with personal data protection and commercial communications regulations applicable in its own jurisdiction (including, where applicable, rules such as the LGPD or other equivalents).
• The content, accuracy, and tone of the messages it sends through the platform.

KollaLabs provides the technical sending and tracking tool; it does not individually review or approve the recipients or specific content each Client chooses to send, and assumes no responsibility for the Client's use of the platform toward third parties.

4. Acceptable use

It is prohibited to use CobraYa! to: send communications to people with no prior relationship to the Client, harass, send deceptive or fraudulent messages, or make any use that violates the underlying messaging platform's policy (for example, WhatsApp's Business Policy).

5. Service availability

CobraYa! is offered "as is" and "as available." We do not guarantee uninterrupted availability, since the service partly depends on external messaging and infrastructure providers.

6. Limitation of liability

To the extent permitted by Bolivian law, KollaLabs will not be liable for indirect damages, data loss, or lost revenue arising from the use or inability to use the platform.

7. Intellectual property

The CobraYa! and Kolla Labs software, brand, and design are owned by KollaLabs. The Client retains ownership of its own data and content uploaded to the platform.

8. Changes to these terms

We may update these terms occasionally. We will notify active Clients of material changes by email or within the dashboard.

9. Governing law

These terms are governed by the laws of the Plurinational State of Bolivia.
